THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Who This Notice Applies To

This Notice of Privacy Practices applies to the medical practice of Brandon P. Hirsch, MD, operating through DISC Sports and Spine Center, Newport Beach and Carlsbad, California. It describes how we may use and disclose your protected health information (PHI) and your rights regarding that information.

How We May Use and Disclose Your Health Information

Treatment

We may use and disclose your PHI to provide, coordinate, or manage your medical treatment. This includes sharing your imaging or medical records with other treating physicians, surgical facilities, or specialists involved in your care.

Payment

We may use and disclose your PHI to bill and collect payment for services rendered, including sharing information with your insurance company, Medicare, or other payers.

Healthcare Operations

We may use and disclose your PHI for internal practice operations including quality assessment, staff training, legal and compliance activities, and business management.

Appointment Scheduling and Contact

Information submitted through website forms — including any uploaded imaging report — is transmitted by email to our practice's Google Workspace account, which operates under a Business Associate Agreement with our practice, and is not stored on this website or its hosting infrastructure.

Other Permitted Uses and Disclosures

We may use or disclose your PHI without your authorization in the following circumstances:

  • As required by federal, state, or local law
  • For public health activities
  • To report suspected abuse or neglect
  • For health oversight activities by government agencies
  • In response to a court order or subpoena
  • To coroners, medical examiners, or funeral directors
  • For organ donation purposes
  • For certain research activities with proper oversight
  • To avert a serious threat to health or public safety
  • For workers' compensation proceedings

Your Rights Regarding Your Health Information

Right to Access

You have the right to inspect and obtain a copy of your medical records. Submit a written request to our office. A reasonable fee may apply for copying.

Right to Amend

You have the right to request amendment of your health information if you believe it is inaccurate or incomplete. We may deny the request if we did not create the information or if we determine it is accurate.

Right to an Accounting of Disclosures

You have the right to request a list of disclosures of your PHI made by our practice, other than for treatment, payment, and healthcare operations.

Right to Request Restrictions

You have the right to request restrictions on how we use or disclose your PHI. We are not required to agree except in limited circumstances required by law.

Right to Confidential Communications

You have the right to request that we contact you only in a certain way or at a certain location.

Right to a Paper Copy of This Notice

You have the right to a paper copy of this notice at any time, even if you have agreed to receive it electronically.
